O’Rourke campaign says it takes threat by Fort Riley soldier seriously

WASHINGTON (AP) — The Latest on an Army soldier from Fort Riley accused of sharing bomb-making instructions online and targeting left-leaning activists (all times local):

The presidential campaign of former Texas Rep. Beto O’Rourke says it is in direct contact with the FBI regarding the case of an Army soldier accused of sharing bomb-making instructions online and targeting left-leaning activists.

When an FBI undercover agent asked Jarrett William Smith if there was anyone in Texas who would be a good fit for “fire, destruction and death,” Smith reportedly replied, “Outside of Beto? I don’t know enough people that would be relevant enough to cause a change if they died.”

O’Rourke spokeswoman Aleigha Cavalier said in an emailed statement that they take any threat like this very seriously. The campaign says this isn’t about any one person or one campaign, and they “won’t let this scare us or cause us to back down in fighting for what’s right.”

The 24-year-old soldier was stationed at Fort Riley in Kansas.

McCain Auditorium lobby to be expanded, renovated

MANHATTAN, Kan. — Thanks to generous donors, the McCain Auditorium lobby at Kansas State University will be expanded, adding new spaces and features to better serve the university and the Manhattan community.

Construction for the project is expected to start in June 2020, adding a modern and inviting entry, more accessible spaces and much-needed patron amenities. The expanded lobby will provide a space for collaborative arts education and other campus and community engagement activities, benefiting students and the K-State community.

This $6 million project is 100% funded by private gifts.

“We are grateful to the many K-Staters and Manhattan community members who invested in this McCain Auditorium lobby expansion project,” said Todd Holmberg, executive director of McCain Auditorium. “The expansion and renovation will enable us to better serve students, community members and those participating in our outreach and educational programming. It will also provide a more welcoming entry to the performing arts, allowing attendees the space for shared human emotions and interactions that are unique to arts experiences.”

This rendering shows how the exterior of McCain Auditorium will look.

Each year, McCain staff work diligently to bring a diverse collection of renowned performing artists to campus, which supports the university’s land-grant mission of engaging and enriching the quality of life for students and citizens throughout the community and state.

RCPD investigating home burglary in Manhattan

MANHATTAN —Law enforcement authorities are investigating a burglary in the 4700 block of Tuttle Creek Blvd. in Manhattan, according to the RCPD activity report.

Two men in their 20, a 55-year-old woman and a 61-year-old man reported an unknown suspect entered the residence and took a black backpack, miscellaneous electronics, and cologne. The estimated total loss associated with this case is approximately 1,127.00. The items were later recovered.

Trial in death of infant in Manhattan ends in hung jury

RILEY COUNTY — The trial of a Manhattan man charged in the death of a baby ended Tuesday when the jury was not able to reach a  unanimous verdict, according to the Riley County Attorney’s office.

D’Khari Lyons, 24, was accused of first degree murder and child abuse for an incident on November 8, 2018. That morning, the Riley County Police Department Emergency Dispatch Center received a 911 call concerning 2½-month-old Michael Calver Jr. not breathing in East Manhattan.  Lyons had been been responsible for watching the child.

The baby was transported to Via Christi in Manhattan then subsequently air-lifted to Children’s Mercy in Kansas City where he died.

Lyons was arrested on a Riley County District Court warrant for First Degree Murder and Abuse of a Child.

Prosecutors said Lyons hurt the child to stop him from crying. Lyons testified he wouldn’t hurt a child and didn’t know what caused Michael’s injuries.

A hearing on the case is scheduled for Oct. 7 to determine how to proceed, according to the Riley County Attorney’s office..

Public meeting Thursday to discuss Manhattan’s smoking ordinance

MANHATTAN— The City of Manhattan has drafted an ordinance combining the Smoking and E-Cigarette ordinances for the City Commission to consider on October 8. City staff will hold a public meeting for any interested stakeholders and the public to discuss the draft ordinance on Thursday, September 26, from 5:30-6:30 pm in the City Commission Room of City Hall, 1101 Poyntz Avenue. In 2008, a petition-referendum process occurred to place an ordinance on the general election ballot that would prohibit smoking in public places and places of employment. The referendum passed by the local electorate, and on January 4, 2009 the ordinance went into effect city-wide. State law allows for the petition-referendum process, and if a referendum passes, it cannot be repealed or amended by the local governing body for 10 years.

Shortly after the local referendum, the State of Kansas passed the Indoor Clean Air Act related to smoking in public places and places of employment in 2010. The state law is similar to Manhattan’s ordinance, but is stricter in certain areas. In 2016, the City Commission passed a separate, but similar ordinance related to the use of e-cigarettes in public places and places of employment.

As of January 4, 2019, the no smoking ordinance is still in effect, but can now be amended or repealed by the governing body. The Flint Hills Wellness Coalition (FHWC) has requested the City Commission combine the two ordinances and clean up some of the ambiguities and differences so it can be enforced consistently. City Staff has prepared a draft ordinance, and will present the ordinance in full detail at the September 26 public meeting, as well as discuss any changes between the two existing ordinances and answer any questions.

On October 8, 2019, at 5:30 p.m. the City Commission will have a Work Session to discuss the draft ordinance. There will be an opportunity for the public at the Work Session to provide comment on the draft ordinance to the City Commission. There will not be a vote on the ordinance at the Work Session. The City Commission will provide feedback on the draft ordinance at that time and give direction to staff on scheduling the ordinance for a vote during a future legislative meeting.

Prosecutor: ‘Satanist’ soldier at Fort Riley sought to overthrow government

TOPEKA, Kan. (AP) — The Latest on the criminal case involving an Army solider charged with distributing explosives information online (all times local):

A prosecutor says an Army soldier charged with distributing information about making explosives online is a Satanist who wanted to overthrow the U.S. government.

Assistant U.S. Attorney Anthony Mattivi said during a federal court hearing Thursday in Kansas that 24-year-old Jarrett William Smith had a specific plan to overthrow the government and told the FBI he was distributing information on explosives “for the glory of his Satanist religion.”

But an attorney for Smith said he is only an internet “troll” who was “spouting off online” and sharing widely available information.

Smith pleaded not guilty to two federal charges of distributing explosives information and a third alleging he threatened to set fire to the home owned by a far-left-leaning “antifa” member. A federal magistrate ordered him detained until his trial.

The indictment charged Jarrett William Smith with two counts related to the explosives and one count linked to trying to gain entry to a home and injure someone listed only as D.H. The indictment alleges he made the threat from Kansas to Michigan.

The 24-year-old private first class and infantry soldier from South Carolina is stationed at Fort Riley, Kansas. He was initially charged in a criminal complaint on Monday. He remains in custody pending a detention hearing Thursday afternoon.

His defense attorney, Rich Federico, declined to comment.

An FBI affidavit filed in support of the initial charges alleged Smith discussed his plan to kill far-left-leaning “antifa” activists and described how to build a bomb that could be triggered by calling a cellphone. It accuses him of posting on Facebook that he was interested in traveling to Ukraine to fight with a paramilitary group known as Azov Batallion. That affidavit had also alleged Smith suggested targeting an unidentified major news network with a car bomb.

Smith has been assigned to Fort Riley since June after serving at Fort Bliss, Texas, beginning in November 2017. He entered the Army from Conway, South Carolina, as an infantryman and completed training at Fort Benning, Georgia. He has not deployed.

Television station WPDE reported that when Smith was a 15-year-old student, he appeared on the “hit list” of another teenager who tried in September 2010 to blow up a high school in Socastee, South Carolina. The indictment makes no reference to that incident.

The station reported that Christian Helms, then 14, brought a gun and other weapons to the school, firing a shot at the school resource officer. Helms had also brought pipe bombs to the school in his backpack and had a list of 13 students who were his intended targets. Smith was among them.

WPDE-TV released a video interview recorded in 2011 in which they interviewed Smith and his father after Helms was sentenced to six years. In it, Smith said he was often bullied at school because of his cleft pallet.

His father, Chris Smith, told the station that the teenager who targeted his son idolized the two killers in the Columbine high school attack in 1999.

One vehicle accident claims the life of Manhattan woman

GEARY COUNTY —The Kansas Highway Patrol has identified the victim in a fiery accident Thursday afternoon on K-177 in Geary County as Nancy C. Barnaby, 72, Manhattan.

KHP said Barnaby was northbound on K-177 in a Ford Explorer, the vehicle crossed over center and went into the west ditch. The Explorer hit a culvert and went air bound. After striking the ground the Explorer rolled and caught fire.

The Geary County Emergency Management Office issued a press release that said authorities need to talk to anyone who was on K-177 Friday afternoon about 3 p.m. and observed the accident scene approximately three miles south of Interstate 70.

Anyone who was in the area or knows anything about the accident is encouraged to contact the Kansas Highway Patrol at 1-785-827-4437 or *47 on your cell phone.

Agencies responding to the accident scene included the Kansas Highway Patrol, Geary County Sheriff’s Department, Geary County Fire Department, Geary County Emergency Management, Junction City Fire / EMS and KDOT.

Police investigating trailer theft in Manhattan

RILEY COUNTY —Police in Manhattan are investigating a theft and asking the public for help with information in the case.

Just before 1:30 Thursday, officers filed a report for theft in the 300 block of North Seth Child Road in Manhattan, according to the RCPD activity report. Penske Truck Rental reported an unknown suspect took a aluminum car trailer.

he estimated total loss associated with this case is approximately $3,500.00. Police ask that anyone with information please contact RCPD or the Manhattan Riley County Crime Stoppers.

Changes are occurring for high school football game times Friday night ( Sept. 26 )

A number of schools have changed their kickoff times for their football games tonight ( Friday ) because of the possibility of inclement weather.

Some of the changes include the Washburn Rural at Manhattan contest which will kick off at 6 p.m. at Bishop Stadium.

The Clay Center at Chapman game is scheduled at 6 p.m., Halstead at Rock Creek 6 p.m., Wamego at Royal Valley at 5:30 p.m. Riley County at Rossville at 5 p.m., Wakefield at Rural Vista at 6 p.m. and Mission Valley at Council Grove at 5:30 p.m.

US probe of vaping illnesses focuses on THC from marijuana

NEW YORK (AP) — U.S. health officials said Friday that their investigation into an outbreak of severe vaping-related illnesses is increasingly focused on products that contain the marijuana compound THC.

Most of the 800 people who got sick vaped THC, the ingredient in marijuana that causes a high, according to the Centers for Disease Control and Prevention. But officials said they didn’t know if the THC is the problem or some other substance added to the vaping liquid, such as thickeners.

“The outbreak currently is pointing to a greater concern around THC-containing products,” said the CDC’s Dr. Anne Schuchat.

So far, investigators have not identified a particular electronic cigarette, vaping device, liquid or ingredient behind the outbreak. But officials say patients have mentioned the name Dank Vapes most frequently. Many of the people who got sick in Illinois and Wisconsin said they used prefilled THC cartridges sold in Dank Vapes packaging.

“It’s a generic product name that doesn’t really tie back to one store or one distributor,” said Dr. Jennifer Layden, chief medical officer for the Illinois Department of Public Health.

“Folks are getting it from friends or folks on the street, with no understanding of where it came from prior to that,” she said Friday.

Until a cause is pinned down, the CDC continues to advise Americans to consider avoiding all vaping products, though the agency on Friday added the phrase “particularly those containing THC.”

“We didn’t feel comfortable dropping the broader recommendation yet,” said Schuchat.

This week, the CDC reported 805 confirmed and probable cases of the lung illness. Thirteen people have died. Only the U.S. has reported such an outbreak, although Canadian officials this week confirmed that country’s first case.

On Friday, the agency provided more details in two reports:

— The first case in the U.S. began in late March. Cases ramped up in late June and rose dramatically in late July.

— Median age for the illnesses is 23. But the median age of those who died is much older — 50.

— Nationally, 9 in 10 cases required hospitalization. Many young and previously healthy adolescents and young adults needed machines to help them breathe.

—The most illnesses have occurred in California, Illinois, Texas and Wisconsin.

— In Illinois and Wisconsin, patients mentioned 87 different product names and many vaped more than one.

Doctors say the illnesses resemble an inhalation injury. Symptoms have included shortness of breath, fatigue, chest pain, diarrhea and vomiting.

Officials continue to find a substantial numbers of U.S. patients — the new report says 16% — who said they vaped only nicotine, and not THC. But the report noted that in Wisconsin, five patients who initially denied using products with THC turned out to have used them.

In Wisconsin and Illinois, recreational marijuana use is currently illegal.

Since 2016, the U.S. Food and Drug Administration has lightly regulated the manufacture and ingredients used in nicotine-based e-cigarettes. But there is no FDA review of THC products, which are illegal under federal law.

The outbreak of illnesses and a surge in underage use of e-cigarettes has brought demands for tighter regulation from politicians, public health officials and parents.

GEARY COUNTY — Law enforcement authorities are investigating a shooting and have made an arrest.

Just before 4:30p.m. Sunday, police responded to report of a shooting and at the same time were notified of teen with a gunshot wound had arrived at Geary Community hospital, according to a media release.

The victim later identified as Coye Crane, 18,  Chapman, was airlifted to KU Medical Center in critical condition, according to the release.

Following an investigation, police determined the shooting occurred in the 200 Block of East 1st street in Junction City. Police have arrested Izek T. Jackson, 18, Enterprise; Javontez K. Brime, 18, Junction City and Malik O. Watkins, 19, Andover, on requested charges of aggravated robbery and conspiracy, according to the release.

RILEY COUNTY— Law enforcement authorities are investigating vehicle thefts in Riley County.

On Sunday, officers filed a report for motor vehicle theft in the 1300 block of Marlatt Ave. in Manhattan. A 48-year-old man reported a known female suspect took his maroon 1994 Buick Century. The estimated total loss associated with this case is approximately $2,000.00.

On Saturday, officers filed a report for motor vehicle theft in the 300 block of N 16th St. in Manhattan. A 25-year-old man reported an unknown suspect took his white 2010 Dodge Ram. The estimated total loss associated with this case is approximately $18,000.00.

On Friday,o fficers filed a report for vehicle theft in the 900 block of Vattier St. in Manhattan. A 42-year-old man reported a known male suspect took his 2001 Dodge Ram. The truck was later recovered. Jimmie Dodson III, 18, of Ogden was arrested in connection on offenses of theft and criminal damage to property. Dodson was issued a total bond of $4,000.00 causing him to remain confined at the time of this report.
