Election hacking puts focus on paperless voting machines in Kansas

ATLANTA (AP) — As the midterm congressional primaries heat up amid fears of Russian hacking, an estimated 1 in 5 Americans will be casting their ballots on machines that do not produce a paper record of their votes.

That worries voting and cybersecurity experts, who say the lack of a hard copy makes it difficult to double-check the results for signs of manipulation.

“In the current system, after the election, if people worry it has been hacked, the best officials can do is say ‘Trust us,'” said Alex Halderman, a voting machine expert who is director of the University of Michigan’s Center for Computer Security and Society.

Georgia, which holds its primary on Tuesday, and four other states — Delaware, Louisiana, New Jersey and South Carolina — exclusively use touchscreen machines that provide no paper records that allow voters to confirm their choices.

Such machines are also used in more than 300 counties in eight other states: Kansas, Arkansas, Indiana, Kentucky, Mississippi, Pennsylvania, Tennessee and Texas, according to Verified Voting, a nonprofit group focused on ensuring the accuracy of elections.

In all, about 20 percent of registered voters nationwide use machines that produce no paper record.

Many election officials in states and counties that rely on those machines say they support upgrading them but also contend they are accurate. In many jurisdictions, the multimillion-dollar cost is a hurdle.

The focus comes as states gear up for the first nationwide elections since Russian hackers targeted 21 states ahead of the 2016 presidential contest. U.S. intelligence agencies have said that there is no evidence any vote tallies were manipulated but that Russians and others are intent on interfering in American elections again.

Last week, the Senate Intelligence Committee issued a report that recommended replacing machines that don’t produce a paper record of the vote.

Some states already have taken that step or are doing so.

Virginia last year banned paperless touchscreen machines two months before the state’s gubernatorial election. This year, Kentucky ordered that all new machines produce a paper trail.

Congress has allocated $380 million to help states with election security upgrades, but that is just a fraction of what would be needed to replace all paperless machines.

Louisiana is soliciting bids to replace the state’s nearly 10,000 such machines ahead of the 2020 election, though all the money has yet to be allocated. Funding also is an issue in Pennsylvania, where Democratic Gov. Tom Wolf has ordered that counties planning to replace their electronic voting systems buy machines that leave a paper trail.

“It’s important because everybody needs to have confidence in the voting process,” Wolf said. “And given what is alleged to have happened in 2016, I think there’s some concern that maybe people aren’t as confident as they should be.”

The rest of the country uses either paper ballots that are filled out by hand and then read by an optical scanner, or a touchscreen machine that prints out a ballot so voters can verify their selections before inserting it into another machine to record their votes.

Since 2016, 46 Texas counties have upgraded their electronic machines, according to the secretary of state’s office. Of those, only 11 went to systems with a paper trail.

San Jacinto County north of Houston is among those that continued with a paperless system when it bought new touchscreen machines. County election administrator Vicki Shelly said that voters have not raised concerns and that she is confident in the new equipment.

“There’s a lot of checks and balances,” she said.

In Georgia, the cost to switch to paper-based machines in the state’s 159 counties ranges from $25 million to more than $100 million, depending on the technology adopted. The state is eligible to receive a little over $10 million from the federal government.

Georgia Secretary of State Brian Kemp has said extensive security measures and cyber defense upgrades make the state’s current system reliable. Those measures include outside security monitoring, regular checks for system vulnerabilities and a backup of voter data that is stored in a secure location.

Amanda Strudwick, a 43-year-old nurse from Decatur, said she has to take Georgia election officials at their word.

“If somebody wants to screw it up, they can do it,” she said at an early voting center in metro Atlanta. “That does not mean opting out of voting. Too many people have fought throughout history for my right to vote.”

Concerns over Georgia’s voting machines have been prominent in the race for the state’s next election chief, with both Democratic and Republican candidates saying the equipment should be replaced.

GOP candidate Josh McKoon released a campaign video showing him taking a baseball bat to a voting machine. During a recent debate, he said close elections such as the 2017 Atlanta mayor’s race require a recount that involves paper records, not just running the tallies on the voting machines a second time.

“Having the paper ballot that can be read and verified for the voter is essential,” he said.

But the 2018 legislative session that ended earlier this month shook the state’s legal landscape. So what has changed and what hasn’t?

CBD is now legal

Quick recap: Cannabidiol, or CBD, is one of the compounds in the cannabis plant that doesn’t get people high, and that advocates say has medical benefits. Some studies have found it helps people suffering from seizures.

Shops in Kansas were certainly selling it and people were buying, but both were technically crimes because whether they get you high or not, CBD products counted as marijuana under Kansas law.

So this year — after years of pleas from the family members of people suffering seizures — lawmakers tweaked the law.

CBD is now legal after Gov. Jeff Colyer signed legislation Monday. And unlike some states — Missouri, for instance, legalized it with tight limits on either who can sell it or who can buy it — Kansas opted for broad access.

Hemp is back

Growing this crop used to be legal and common. In 2014, the federal government began allowing it again in limited circumstances. Hemp is in a bunch of products — fabrics, foods, building materials, you name it — but right now the U.S. mostly imports from places like Canada and China.

Hemp comes from the same plant species as marijuana, just a different variety with taller stalks (to maximize fiber yield) than the one people use to get high.

Kansas is taking the federal government up on its offer to allow regulated pilot programs for growing, researching and selling hemp. The state agriculture department is working on finding farmers and setting up that program.

Marijuana is still a no-no

So here’s a good rule of thumb now for cannabis-related products in Kansas: if it gets you high, it’s definitely illegal.

At least 30 states let people use marijuana. In most of them, you need a doctor’s prescription.

Kansas advocates of medical marijuana continue to push for that, but neither their House bill nor Senate bill got a hearing this year.

Kan. man arrested for boat crash that killed 3 friends; KSU student hospitalized

CAMDEN, Mo. (AP) — Authorities allege a Kansas man was intoxicated when the boat he was operating struck a rock bluff on the Lake of the Ozarks in central Missouri, killing three friends.

Hayden Frazier, 22, of Overland Park, was released from jail Sunday morning. He was arrested Saturday on three preliminary charges of boating while intoxicated involving a death of another person. It wasn’t immediately clear when formal charges will be filed.

The Missouri Highway Patrol on Sunday identified says the three victims who were killed: 23-year-old Joseph LeMark, of Overland Park; 24-year-old Daniel Lewis, of Overland Park; and 21-year-old Hailey Hochanadel, of Olathe.

Authorities say 21-year-old Ashley Lamb, of Olathe, was in serious condition after being flown to a Springfield, Missouri, hospital. She is a student at Kansas State, according to the University Student Directory.

The crash happened before 2 a.m. Saturday, throwing three people into the water, authorities said. All five people involved were friends who graduated from high school in Olathe.

Accident reports say Frazier, Hochanadel and LeMark were ejected into the water in the crash that happened before 2 a.m. Saturday. State Patrol Sgt. Scott White said Frazier climbed back aboard and paddled the 1991 Regal Runabout across the channel to a dock at Simmons Point.

Police report theft of utility trailer in Manhattan

On Friday police filed a report for theft of a utility trailer from Prime Place, LLC, in the 1500 block of College Ave. in Manhattan. The estimated total loss associated with this case is approximately $1,200.00.

Memorial Day hours and magic show set for Manhattan Town Center

Annual seat belt enforcement campaign underway in Kansas

TOPEKA, Kan. (AP) — If you don’t use your seat belt, this might be a good week to start.

Monday is the start of the annual statewide law enforcement campaign “Click It or Ticket,” which runs through June 3. At least 160 law enforcement agencies will be emphasizing enforcement of the seat belt and child restraint laws.

Kansas law requires everyone 8 or older to be buckled in when riding in most vehicles. Children under age 4 must be in an approved child safety seat and those 4 to 7 must be in a booster seat until they are taller than 4-foot-9 or heavier than 80 pounds.

Fines for violating the laws range from $30 to $168.

The Kansas Department of Transportation reports nearly half of the 359 people killed in traffic accidents last year weren’t wearing seat belts.


Police report 4 recent burglaries in Riley County

MANHATTAN — Law enforcement are investigating three Friday burglaries and asking for help with information to help solve the crimes.
Just after 7a.m. Officers filed a report for burglary in the 1300 block of Flint Hills Pl. in Manhattan. Officers listed Carole Humphrey, 41, of Manhattan as the victim when it was reported an unknown suspect took a Samsung TV from the victim’s residence. The estimated total loss associated with this case is approximately $500.00. Police ask that anyone with information contact RCPD or the Manhattan Riley County Crime Stoppers. KSU senior remains in ICU after fatal boat crash

RILEY COUNTY  —The sister of a Kansas State student critically injured in a fatal Missouri boat crash May 19 is asking the public for help.

Twenty-one year old Ashley Lamb of Olathe was flown to a Springfield hospital after the 2a.m. crash that killed three others.

According to the GoFundMe page, Lamb, a senior at Kansas State University, is in the hospital’s ICU facing a long road to recovery.

The Missouri State Highway Patrol arrested Hayden Frazier, 22, of Overland Park, Saturday on three preliminary charges of boating while intoxicated in connection with the crash.

The three victims who were killed are 23-year-old Joseph LeMark, of Overland Park; 24-year-old Daniel Lewis, of Overland Park; and 21-year-old Hailey Hochanadel, of Olathe, according to the Missouri State Highway Patrol.

Kansas Supreme Court justices who are skeptical that state lawmakers have sufficiently increased school funding this year are struggling with whether they have enough information to say exactly what’s adequate.

Four of the court’s seven members expressed doubts Tuesday about a new law approved this year that phases in a $548 million educating funding increase over five years. The court heard arguments from attorneys on whether the increase is adequate under the state constitution.

But skeptical Justice Dan Biles later suggested in questioning attorney Alan Rupe that the Supreme Court might have to order more fact-finding by a lower court about what funding would be adequate. Rupe represents four school districts suing the state.

Chief Justice Lawton Nuss also questioned whether the Supreme Court needs more information.

Three of the Kansas Supreme Court’s justices have expressed skepticism that a public school funding increase approved by lawmakers this year is adequate under the state constitution.

The seven-member court heard arguments Tuesday on the state’s plan to spend $548 million more, phased in over five years. The increase approved by lawmakers this spring and signed by Gov. Jeff Colyer was the second hike in two years. Many lawmakers see it as a sizable boost.

But Justice Dan Biles suggested from the bench that the increase still would leave Kansas five years behind in providing adequate funding to its schools. Justices Eric Rosen and Marla Luckert also were skeptical of the increase.

State solicitor general Toby Crouse said the hike gives the state a “fulsome funding system.”

 

TOPEKA, Kan. (AP) — Kansas lawmakers are looking for hopeful hints from the state Supreme Court that they’ve increased education funding enough to satisfy the justices and head off any potential threat of a court order shuttering public schools.

But attorneys for four school districts suing the state were preparing to argue Tuesday that the plan lawmakers and Gov. Jeff Colyer settled on this spring, a $548 million increase phased in over five years, still falls as much as $1.5 billion short of providing a suitable education for every child. The Supreme Court is hearing arguments in a lawsuit filed by the districts in 2010, when this year’s high school graduates were fifth-graders.

The court ruled in October that the state’s current education funding of more than $4 billion a year isn’t sufficient under the Kansas Constitution, even with an increase approved last year. The school districts want the justices to declare that legislators are still short — and to order lawmakers to approve more spending by the end of June.

The justices have promised only to issue their next ruling by June 30. In past hearings, they’ve peppered attorneys for the state and the school districts with questions and have not been shy about expressing frustration with lawmakers.

“What we are interested in is having the Legislature live up to the court’s charge,” said Alan Rupe, the school districts’ lead attorney. “What the Legislature has come up with is a plan that falls way short.”

Colyer, who is Republican, and the GOP-controlled Legislature have worried that if the court isn’t satisfied, it will declare that the state cannot distribute its education dollars through an unconstitutional funding formula — effectively keeping schools closed until legislators approve a fix.

The court threatened to do just that in 2016 to get lawmakers to increase aid to poor school districts. But Rep. Fred Patton, a Topeka Republican and chairman of a special House committee on school funding, said he would be shocked if the court went that far this time.

“You cannot argue that we did not put in a substantial amount of money and school districts won’t benefit,” Patton said.

But the districts’ attorneys note that a study commission by legislators this year said improving schools could cost as much as $2 billion more a year, depending on the state’s ambitions for improving standardized test scores and graduation rates.

Fire at KSU’s Hale Library contained; building to remain closed

MANHATTAN —Crews have contained the fire at Hale Library on the Kansas State University campus. The building will remain closed until further notice.  The university also must bring down online systems including HRIS, KSIS and Canvas due to the fire.

Seventy firefighters and emergency personnel combined were on the scene from multiple departments battling the fire at the library Tuesday.

They included Fort Riley, and Manhattan Fire Department. No injuries have been reported. The building was evacauted.

Firefighters were focused on  extinguishing the top of the blaze at the northeast corner of the building.

There is no word on what caused the fire.

The library was built in the 1920s and underwent a massive remodel and addition in the 1990s.

Pottawatomie Co. woman hospitalized after 2-vehicle crash

POTTAWATOMIE COUNTY — One person was injured in an accident just before 3p.m. Tuesday in Pottawatomie County.

The Kansas Highway Patrol reported a 2001 Chevy passenger car driven by Jennifer M. Rogers, 43, St. George, was westbound on U.S. 24.

The driver attempted to turn south onto Rockenham Road, fail to yield, and was struck by an eastbound 2018 Dodge passenger vehicle driven by Scott L. Moses, 30, Topeka.

Rogers was transported to the hospital in Manhattan. Moses was not injured. Both drivers were properly restrained at the time of the accident, according to the KHP.

Police investigate report of alleged commercial sexual exploitation of a child

MANHATTAN — Law enforcement authorities are investigating a teen for an alleged child sex crime.

On Tuesday, police filed a report for aggravated unlawful transmission of a visual depiction of a child and commercial sexual exploitation of a child in Manhattan, according to the Riley County Police Department Activity report.

A 16-year-old girl was the suspect in a case involving another 16-year-old girl.

Due to the nature of the crime reported, no additional information will be released

GEARY COUNTY — One person was injured in an accident just after 11a.m. Wednesday in Geary County.

The Kansas Highway Patrol reported a 2010 Chevy van driven by Samuel Gary Lowry, 29, Topeka, was southbound on Kansas 177 ten miles south of Interstate 70;

The van left the roadway, entered the west ditch, struck a culvert, went airborne and had a hard landing.

Lowry was transported to the hospital in Manhattan. He was properly restrained at the time of the accident, according to the KHP.

Rookstool-has a previous drug conviction, according to the Kan. Dept. of Corrections

RILEY COUNTY — Law enforcement authorities are investigating a Kansas man for alleged drug distribution. Just after 2:30 Wednesday, police arrested 48-year-old Samuel Rookstool, 48, of Clay Center, in the 4400 block of Kauffman Drive in Manhattan, according to the Riley County Police Department activity report.

He was arrested on a Riley County District Court warrant for distribution of methamphetamine.

Rookstool is being held on $10,000.00 bond, according to the RCPD arrest report.
